The Arizona Supreme Court recently issued a unanimous decision that provides clarity for unwed fathers seeking to establish parental rights. In “In re Termination of Parental Rights as to M.N.”, the court determined that Arizona law provides two distinct legal pathways for unwed fathers—one for "potential fathers" and another for "putative fathers." The ruling ensures that fathers who comply with one statutory requirement do not need to fulfill both, protecting their rights in adoption cases.
Understanding Arizona’s Legal Framework for Unwed Fathers
Arizona law outlines two ways for unwed fathers to assert their parental rights:
Potential Fathers (A.R.S. § 8-106): A mother must identify all potential fathers of her child, allowing them the opportunity to file a paternity action and object to an adoption.
Putative Fathers (A.R.S. § 8-106.01): Fathers can voluntarily register with the state’s putative fathers registry. Failure to do so results in a waiver of parental rights.
This distinction became crucial in the case at hand. The biological father, initially unknown to the adoption agency, attempted to establish paternity through a blood test but was denied. When he was later identified, a test confirmed his paternity. However, the lower court terminated his parental rights because he had not filed with the putative fathers registry.
The Court’s Ruling and Its Impact on Parental Rights
The Arizona Supreme Court reversed the termination, clarifying that fathers who meet the legal requirements under the potential fathers statute do not need to also register as putative fathers. The justices emphasized that the statutes serve different purposes and should not be used to deprive fathers of their legal or constitutional rights.
This decision reinforces the principle that while adoption laws aim to provide stability for children, they should not unduly strip fathers of their rights when they have acted within legal parameters. The case now returns to the trial court for further proceedings.
