In order to successfully litigate a premises liability injury case such as a trip and fall/slip and fall, it’s important to document the condition, witnesses and notice. For example, if you are in the super market and you are walking down the aisle and you slip on a substance, it is very important to be able to document what the substance was that caused you to fall….that’s the first step.
The second step is being able to document how long that substance had been on the floor prior to you slipping and falling. Sometimes that can be very challenging and that’s where an attorney comes in to conduct discovery to find out from the owner of the supermarket whether or not there are any records to show the last time the aisle had been inspected.
These are known as sweep records that document the last time that an employee had gone down that aisle. If the substance had been there for quite some time that’s something that you as the injured party may be able to prove. The classic example is the banana peel.
If there’s a banana peel on the floor that causes you to slip and fall, the brown banana peel is much stronger case than the peel that had just been thrown there. The point is that the owner of the property either knew or should have known of the dangerous condition.]]>
